Detailed guidelines
Offer — products and services
The buyer must know what they are buying: the essential features of the goods or service, the full price and — for products — an illustrative photo of the item being sold.
Items on offer
- The items sold must be your property or you must have the right to resell them.
- The offer must not violate applicable law.
- Every item must be accurately described and presented — including its essential features, the manufacturer and, where applicable, safety warnings and instructions. Products must be safe, i.e. pose no risk under normal conditions of use.
- For products, add an illustrative photo (not required for services).
Selling digital content
- Provide information about the validity period of the digital content.
- Indicate the technical protection measures of the digital content relevant to its compatibility with computer hardware and software.
Prices and costs
- State the total price including taxes, together with transport, delivery and any other charges.
- For subscriptions and open-ended contracts, state the total price per billing period or the fixed monthly fee.
Purchase process
- The website contains a purchase panel — a cart or an order form.
- When placing an order, the customer must be aware of the obligation to pay — a button such as "order and pay" is required.
Shop terms and conditions
The terms and conditions are legally binding (the Act on Providing Services by Electronic Means, the Consumer Rights Act). Make them available free of charge in a visible place on the website, in a form that allows the content to be obtained, reproduced and stored (e.g. a downloadable PDF) — the customer must be able to accept them before purchase. They should also describe the technical requirements for using the shop and the conditions for concluding and terminating contracts.
Company registration details
- Full company name according to the National Court Register (KRS) or the relevant register.
- NIP, REGON and KRS numbers (if assigned).
- Registered address and contact details enabling quick contact — a phone number and an e-mail address.
Order fulfilment method and time
- Available delivery methods.
- Order preparation time — needed to assemble the order and hand it over for shipping — expressed in business days or in hours (24h/48h/72h).
- If the preparation time differs between goods, state the average and maximum fulfilment time. Example wording: "The average order fulfilment time is 2–3 business days; for products requiring longer preparation for shipping — up to a maximum of 10 business days."
Order fulfilment restrictions
- Any possible restrictions on order fulfilment and their source (e.g. export regulations, the nature of the goods).
- Additional requirements the customer must meet for the sale to be completed.
- The territorial scope of order fulfilment.
- Statutory restrictions — e.g. the ban on online alcohol sales, OTC medicines sold exclusively by pharmacies, the BDO register for selected goods.
Returns
- 14 days to withdraw from the contract without giving a reason, regardless of the payment method — counted from the delivery of the goods or performance of the service.
- Failure to inform about the right of withdrawal extends this period to 12 months.
- The possible manner and circumstances of making a return and instructions for submitting it.
- The return address (it may differ from the registered address) and contact details for returns — a phone number and an e-mail address.
- Information on when and how the funds will be returned and who bears the direct cost of returning the goods.
- Statutory exclusions of the right of withdrawal with justification (Article 38 of the Consumer Rights Act) — e.g. made-to-order goods, sealed hygiene products, as well as digital content not delivered on a tangible medium, if performance began with the consumer's express consent before the withdrawal period expired and after informing them about the loss of this right.
Complaints
- The obligation to deliver goods free from defects — liability for the conformity of the goods with the contract.
- Deadlines and rules for handling complaints.
- The address to which the goods under complaint should be sent.
- The way the complaint is resolved: refund, replacement with new goods or repair.
- The content of the warranty and after-sales services and how they are provided (if you offer a warranty).
Personal data protection — privacy policy
Information about personal data protection must be available on the shop website as a separate, easily accessible document. Your privacy policy should include:
- Details of the company acting as the personal data controller — full name according to the KRS or the relevant register, NIP / KRS / REGON, address.
- The legal basis for processing buyers' personal data — consent, contract or the controller's legitimate interest.
- The purpose of collecting and processing the data and its retention periods (information clause).
- How the personal data is protected.
- Information on how customers can access their data and how they can change or delete it.
- Details of the entities to which the personal data is disclosed (if applicable).
- Rules for the use of cookies (cookie policy).
Remember: In order to process payments, buyers' personal data is shared with Paymentic Sp. z o.o., which acts as its controller. Include this information in your shop's privacy policy and link to the current Paymentic privacy policy.
Paymentic privacy policyTechnical requirements — website address
- The shop website runs exclusively over HTTPS, with a valid TLS certificate.
- The website address matches the payment point address declared in the agreement with Paymentic — report any address change before implementing it.
- The website is publicly accessible: no logins, passwords, regional blocks or an "under construction" mode.
- The purchase process does not redirect the customer to other, undeclared domains.
- The website must not offer goods or services that violate the law or are excluded under the Paymentic Payment Terms.
Legal basis
The above requirements arise, among others, from the Act of 18 July 2002 on Providing Services by Electronic Means, the Act of 30 May 2014 on Consumer Rights and the GDPR. You can find an overview of an online seller's obligations at biznes.gov.pl.
What's next?
